Terms & Conditions for Virtual Novena App
1. Introduction
Welcome to Virtual Novena, a service provided by Glow Collective LLC ("we," "our," "us"). These Terms and Conditions ("Terms") govern your use of the Virtual Novena application ("App"). By using our App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.
2. Use of the App & Product Description
Virtual Novena is a mobile app that provides users with a virtual meeting service for family and friends to perform the Novena, a series of Catholic prayers for a recently deceased person.
2.1 SMS Messaging
This app incorporates an SMS messaging service. Please see Section 3 below for details. The use of our App is subject to these Terms and any applicable laws and regulations.
2.2 Account Registration
To use certain features of the App, you may need to create an account. You agree to provide accurate and complete information when registering an account and to keep this information up to date. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3. Opt-In Messaging Service
To connect users to Novena(s) as either a 'host' or 'participant,' participants agree to (1) receive an email or text message generated by a novena host and/or (2) agree to opt-in to text messaging when downloading the Novena app from the App Store where they must enter their phone number and consent to receive messages from Virtual Novena (novena-app.com) by the Glow Collective LLC. A link to the iPhone App Store where the Novena-App can be downloaded. If a user has already downloaded the app, the link will direct the user to open the app instead. Users may "Opt-out" of the messaging service at any time by texting "STOP," "QUIT," or "REMOVE" as instructed by the SMS message.
3.1 Consent to Receive Messages
By clicking the SMS link to download the Novena-app, you consent to receive text messages from Glow Collective LLC's Virtual Novena app. These messages will include either a link to download the App or direct you to the App if it is already installed on your device.
3.2 Message Frequency
Message frequency may vary. We may send you messages related to updates, notifications, and other information relevant to your use of the App.
3.3 Opting Out
Users may "Opt-out" of the messaging service at any time by texting "STOP," "QUIT," or "REMOVE" as instructed by the SMS message. If you opt out, you may not receive important updates or other information about the App or your Novena.
3.4 Message and Data Rates
Message and data rates may apply to each text message sent or received, as provided in your mobile telephone service plan. Please contact your mobile telephone carrier for details.
4. User Conduct
You agree to use the App in a manner consistent with all applicable laws and regulations. You agree not to:

Transmit any content that is offensive, inappropriate, or harmful.

Engage in any activity that interferes with or disrupts the App or the servers and networks connected to the App.
5. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Glow Collective LLC or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content from the App without our express written permission.
6. Privacy Policy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.
7. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation or availability of the App, or the information, content, materials, or products included on the App. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Glow Collective LLC shall not be liable for any damages of any kind arising from the use of or inability to use the App, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
9. Changes to the Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting of the revised Terms. Your continued use of the App following the posting of changes constitutes your acceptance of such changes. It is your responsibility to review these Terms periodically.
10. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
11. Governing Law
These Terms and your use of the App shall be governed by and construed in accordance with the laws of the jurisdiction in which Glow Collective LLC is established, without regard to its conflict of law provisions.
